Rights and Duties of Parents and Children with Emphasis on the Legal Systems of Iran and England

Family law is one of the most important branches of civil law and plays a fundamental role in preserving the dignity, security, and welfare of family members, particularly children. Child maintenance, as one of the major duties of parents, holds a special legal and jurisprudential position, as it guarantees the provision of the child’s basic needs and healthy development. Using a comparative approach, this study examines the rights and duties of parents in the legal systems of Iran and England and analyzes the status of child maintenance from the perspective of Islamic jurisprudence and domestic laws. The comparative analysis indicates that, in both legal systems, the protection of children is of great importance; however, there are differences in the way parental duties and children’s rights are defined and enforced. In the Iranian legal system, jurisprudential and Sharia-based foundations play a key role in determining family rights and duties, whereas in the English legal system, greater emphasis is placed on the welfare of the child and international human rights law. By using the method of analyzing legal texts, international documents, and jurisprudential sources, the researcher identifies the strengths and weaknesses of each system. The findings show that strengthening protective legislation and promoting legal education can be an effective step toward guaranteeing children’s rights and ensuring the proper fulfillment of parental duties.
