Abstract

Administrative appeal against individual administrative decisions constitutes an important legal safeguard for protecting individuals from unlawful or arbitrary administrative action. It provides an internal mechanism through which the administration may reconsider, amend, withdraw, or confirm a contested decision before the dispute reaches the administrative judiciary. This study examines the legal framework governing administrative appeal in Iraqi and Egyptian legislation through a comparative analytical approach, with particular attention to its legal nature, admissibility requirements, procedural guarantees, legal effects, and relationship with judicial review. The study seeks to determine whether administrative appeal operates as an effective means of protecting individual rights or whether, in practice, it may become a procedural burden that delays access to justice. The analysis demonstrates that the Egyptian system is comparatively more structured and developed in regulating administrative grievances, especially regarding procedural requirements, administrative silence, and the relationship between prior grievance and judicial proceedings. Nevertheless, the requirement to exhaust administrative remedies in certain disputes may transform the appeal from a protective right into a procedural restriction where the internal review mechanism is slow or ineffective. In contrast, Iraqi law provides comparatively broader access to direct judicial review but suffers from fragmented statutory regulation, the absence of a unified administrative-procedure framework, and insufficient clarity regarding grievance procedures, administrative silence, suspension of execution, and the effect of grievance decisions on judicial time limits. The study concludes that both systems require reform, although the nature of reform differs. Iraq requires greater legislative codification, procedural consistency, and clearer guarantees for administrative reconsideration, whereas Egypt requires greater proportionality in the use of mandatory administrative exhaustion. In both systems, administrative appeal should be designed to ensure timely review, reasoned decisions, clear legal consequences, and effective access to judicial protection.
